Draft law of the Kyrgyz Republic “On Amendments to the Law of the Kyrgyz Republic “On State Guaranteed Legal Aid” is being developed in Kyrgyzstan

July 31 – August 2, 2019, Kara-Oi village, Issyk-Kul oblast.  Meeting of the working group on development of the draft law “On Amendments to the Law of the Kyrgyz Republic On State-Guaranteed Legal Aid” (SGLA) was held. The working group was established on May 14, 2019 by the decision of the KR Parliament Committee on Constitutional Legislation, State Structure, Judicial and Legal Issues and the Rules of Procedure of the Jogorku Kenesh.

The head of the Parliament committee department sector Beishenbek kyzy Kamila acquainted participants with the monitoring results of the Law of the Kyrgyz Republic “On SGLA” norms implementation.

Akjol Kalbekov, Director of the Center for Coordination of SGLA under the Ministry of Justice of the Kyrgyz Republic, informed participants on implementation of the Law of the Kyrgyz Republic “On the SGLA” and about the problems revealed during its practical implementation. He also shared with the vision of the Center for Coordination of SGLA on amending the Law, which would contribute to provision of population with efficient and high-quality free legal aid within SGLA.

A member of the working group, Aliya Kalybaeva, told about the problems identified during implementation of the Law on SGLA. As one of the main problems, expert noted the lack of permanent employees of the Free Legal Aid Centers (FLA Centers). The working group proposed to provide full-time employees in all FLA Centers, who will provide citizens with access to primary legal assistance in each district of the republic.

The working group worked out the regulations on provision of primary legal aid, as well as on the qualified legal assistance in criminal and civil cases during the meeting.

According to Aida Mambetova, Deputy Head of the Department of the KR Parliament Committee on Constitutional Legislation, State Structure, Judicial and Legal Issues and the Rules of Procedure of the Jogorku Kenesh, the draft law will be widely discussed with all interested parties in order to take into account the views of all entities of the State-Guaranteed Legal Aid System.

The meeting is held at the initiative of the  work group members of the KR Parliament Committee on Constitutional Legislation, State Structure, Judicial and Legal Issues and the Rules of Procedure of the Jogorku Kenesh, with support of the UNDP project and the Ministry of Foreign Affairs of Finland “Towards sustainable access to justice for legal empowerment in the KR” and the European Union Program “Rule of law in the KR – 2nd phase”.
